The petitioner has filed the additional affidavit for disposal of the writ petition in terms of the judgment dated 25.10.2007 passed in CWP No. 2475/2006: Rajasthan Mahila Vidhyalaya Vs. State of Rajasthan & Ors.

It has been pointed out by the learned Senior Counsel Mr. M.S. Singhvi that the judgment aforesaid has been upheld by the Hon''ble Division Bench in the order dated 27.08.2010 as passed in SAW No. 02696/2009 : State of Rajasthan & Ors. Vs. Rajasthan Mahila Vidhyalaya, Udaipur. The learned counsel has also referred to the order dated 18.07.2011 as passed in CWP No. 9434/2009 : Vidhya Pracharani Sabha, Old Station Road, Udaipur Vs. The State of Rajasthan & Ors.

The learned counsel appearing for the respondents could not dispute the position that the issue involved in this writ petition stands squarely covered by the decisions aforesaid.

Following the aforesaid decision dated 25.10.2007 as passed in CWP No. 2475/2006, this writ petition is also allowed on the same lines and in the same terms. The respondents shall grant approval and release the grant-in-aid to the petitioner-Society in regard to :

(1) - the arrears resulting from the enhancement of salaries under the 6th Pay Commission;

(2) - the arrears of salary paid by the petitioner to its employees as a result of revisions of pay scales in accordance with the Rajasthan Civil Services (Revised Pay Scales), 1998;

(3) - the arrears of dearness allowance to the petitioners'' employees as a result of grant of additional installments of dearness allowance;

(4) - the amount of selection grades w.e.f. 1.1.1993 shall be admissible to the employees as per the order dated 25.01.1992 issued by the State Government; and

(5) - the leave enhancement for which the employees are entitled at par with the employees of the State Government.

The entire exercise for grant of approval and release of the grant-in-aid may be completed with a period of three months from the date of the petitioner society submitting its claim in accordance with the provisions of Rajasthan Non-Government Educational Institutions (Recognition, Grant-in-aid and Service Conditions etc.) Rules, 1993.

No order as to costs.
