Heard learned counsel for the parties.
The writ court on 31.07.2018 passed the following order:
"The dispute is regarding plot No. 461M, 464M and 467M situated in village Harsaun, District Ghaziabad.
The controversy raised in the writ petition is related to Section 24(2) of The Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
Therefore, in view of the order dated 21.2.2018, passed by the Hon'ble Supreme Court in Special Leave to Appeal (C) No. 8453 of 2017 (State of Haryana and Ors. Vs. M/s G.D. Goenka Tourism Corporation Limited and another), this writ petition is adjourned sine-die with liberty to the parties to mention for taking it up after a disposal of the above case by the Apex Court.
Let this petition be connected with Civil Misc. Writ Petition No. 8786 of 2018."
The learned counsel for the applicant submits that the Ghaziabad Development Authority, Ghaziabad has flouted the order by issuing fresh notices of auction of the property in dispute.
On specific query, the learned counsel for the applicant is unable to point out from the order of the writ court, whether, there is any positive direction restraining the opposite party from proceeding with the auction. In other words, the learned counsel is unable to point out civil contempt committed by the opposite party in violation of the writ court order.
In view thereof, accordingly contempt petition is dismissed.
