Judgment

Heard Mr. Somik Deb, learned senior counsel assisted by Mrs. Riya Chakraborty, learned counsel appearing for the petitioners as well as Mr. Samarjit Bhattacharjee, learned counsel appearing for the respondents.
The order dated 24.08.2021 passed by learned Civil Judge, (Sr. Division) Kailashahar, Unokoti Judicial District is set aside. The trial Court shall re-examine the matter if the petition is otherwise in order.
The delay is condoned in view of the orders passed by the Apex Court and the Division Bench of this Court. Though there were not many pandemic cases reported in Tripura, further, the Court has physically functioned, the orders passed by the Apex Court in the context of COVID-19 cannot be ignored and the benefit of the extension of the orders and the computation of limitation which has been decided by the Apex Court needs to be considered in a pragmatic manner and, accordingly, the condoned delay application which is dismissed by the trial Court vide order dated 24.08.2021 is set aside and review petitions on the file of trial court stands restored.
Accordingly the instant CRP stands allowed and disposed of.
