Judgment
R. Sudhakar, J.—This writ petition has been filed by the Petitioner to issue a Writ of Mandamus to forbear the second Respondent from granting permission to perform drama in Veerakudi Village, Virudhunagar District, in the event of Aadi Theertha festival of Arulmigu Murugaiyanar Thirukkovil.
In view of the order that is to be passed, notice to the Respondents 3 and 4 is dispensed with.
Heard Mrs. J.Anandha Valli, learned Counsel for the Petitioner and Mr. TR.Janarthanam, learned Additional Government Pleader who takes notice for the Respondents 1 and 2.
By consent, the writ petition itself is taken up for final disposal.
The Petitioner has made a representation on 09.08.2011 inter alia contending that the Petitioner has been excommunicated by the members of the same community. The said representation has been received by the Inspector of Police and has been duly acknowledged. In the said representation, there are other grievances which related to the performance of certain festival by the third parties without the permission or consent of the Petitioner.
This Court is not inclined to interfere with these issues at this point of time. However, the second Respondent/Inspector of Police will consider the representation of the Petitioner, insofar as it relates to the social ostracism alone and if one or other person indulges in excommunication of the other person in the village or the community and deprives them of their life and liberty, the Inspector of Police shall see to it that the individual liberty is not curtailed contrary to law.
With these observations, this writ petition is disposed of. Consequently, the connected Miscellaneous Petitions are closed. No. costs.
