Judgment
Alok Kumar Verma, J
The applicant – Sehnawaz is in judicial custody under Section 3, Section 5 read with Section 11 of the Uttarakhand Protection of Cow Progeny Act, 2007 and Section 132 of the Bharatiya Nyaya Sanhita, 2023 in Case Crime No.143 of 2025, registered at Kotwali Roorkee, District Haridwar.
As per the First Information Report dated 17.04.2025, the police party raided the spot on a secret information and recovered 110 kg. beef and other articles. The present applicant was arrested by the police.
Heard Mr. Bilal Ahmed, learned counsel for the applicant and Mr. G.S. Sandhu, learned Additional Advocate General for the State.
Mr. Bilal Ahmed, Advocate, contended that the applicant has been falsely implicated in the present matter. He was not present at the spot. When he was going to market to purchase some household articles, the police arrested him. Nothing was recovered from his possession. He is not a previous convict. He is in custody since 17.04.2025.
Mr. G.S. Sandhu, Additional Advocate General for the State has opposed the bail application.
Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.
The Bail Application is allowed.
Let the applicant – Sehnawaz be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
