This writ petition is filed seeking the following prayers:

“(i) To call for records leading to Ext.P4 and P6 and to quash the same by issuing a writ of certiorari or any other appropriate writ, order.

(ii) Issue a writ of mandamus or appropriate writ order or direction directing the respondents 2 to 5 to retain the petitioner in service as Asha worker in ward No.13 of Kizhakke Kallada Grama Panchayath.

(iii) Issue a writ of mandamus or appropriate writ order or direction directing the 3rd respondent to appoint a new Asha worker in ward No.5 of Kizhakke Kallada Grama Panchayath.”

Heard the learned counsel for the petitioner, the learned standing counsel appearing for the NHM, the learned Government Pleader as well as the learned standing counsel appearing for the Panchayat. In view of the directions being issued, notice to the 6th respondent is dispensed with.

It is submitted by the learned counsel for the petitioner that the petitioner is working as Asha worker in Ward No.13 of the Kizhakke Kallada Grama Panchayath and that she has been working in the said ward for the past 15 years. It is submitted that the 6th respondent has been issued with Ext.P1 order of transfer and that the petitioner had not been heard before the said order was passed.

The learned counsel appearing for the NHM would submit that Ext.P5 would show that there is a District Level Committee consisting of the Chief Executive Officer of the NHM, District Program Manager, Deputy Director of Panchayath, Regional Joint Director and District Asha Co-ordinator to look into the grievances of the Asha workers at the district level. In case the petitioner approaches the said Committee with an appropriate representation, the grievance of the petitioner with regard to Ext.P1 will be considered with notice to the petitioner as well as respondents 4 to 6.

In the above view of the matter, this writ petition is disposed of directing that in case the petitioner approaches the said Committee within a week from today, an appropriate decision after hearing all concerned will be taken by the Committee within a period of one month thereafter. The 2nd respondent shall see that the directions contained herein are appropriately implemented. Status quo as on today shall continue till then.
