Petitioners had been working in Sarswati Senior Secondary School, Gohar, from the year 1995 to 2002, when the school was upgraded. On account of up-gradation of the school, petitioners'' services became surplus and were, therefore, dispensed with. A reference was made by the Deputy Director Education, vide Annexure A-4, to the Director Education i.e. respondent No. 2 herein, for accommodating the staff that had become surplus. Petitioners'' claim is that they fulfill the requisite qualification and, therefore, they deserve to be accommodated.

No order has been passed on Annexure A-4, the letter dated 19.02.2002, written by the Deputy Director to the Director, whereby statement of left out staff of the aforesaid school was sent to the Director Education (respondent No. 2). So, the present petition is disposed of with a direction to respondent No. 2, Director of Education, to pass appropriate order on Annexure A-4, the letter dated 19.02.2002, addressed to him by the Deputy Director, forwarding therewith the list of left out staff of the school, in question. Respondent No. 2 (Director Education) shall pass a speaking order on the aforesaid letter Annexure A-4, within two months from the date of receipt of this order by him and before passing order, he shall afford an opportunity to the petitioners to make representation or to be heard in person, in support of their claim for being accommodated them in some other school.
