The petitioner society is faced with an exparte order for payment of gratuity. According to the petitioner, though a counsel was engaged he did not appear in the case inspite of having filed a vakalat. The dispute is regarding the quantum of wages.
After hearing the learned counsel on both sides, I am of the opinion that an opportunity can be granted to the petitioner provided one-half of the amount ordered under Ext.P1 is paid.
It is noticed that pursuant to the interim order dated 18.08.2023 passed by this Court, the petitioner has paid an amount of Rs.50,000/-.
In the light of the above, it is ordered that Ext.P1 order will stand set aside on condition that the petitioner pays a further amount of Rs.1,00,000/- (Rupees One Lakh only) to the 4th respondent within a period of three weeks. On such payment, the addl.5th respondent shall take up G.C.No.33 of 2017 back to file, re-hear the same and pass appropriate orders. The same shall be done within a further period of two months thereafter.
