Judgment
Ms. Pujari, learned advocate appears on behalf of petitioner (management). She submits, impugned is order dated 15th May, 2019 rejecting her client’s application made under section 36(2)(b) in Industrial Disputes Act, 1947. On query from Court she submits, though Sri Gobardhan Pujari is no more, her client wants to prosecute the writ petition for representation by Sri Tusarkanta Sahu.
She submits further, one of us (S.K. Mishra,J.) was appointed amicus curiae in the matter. On query from Court she submits, pursuant to the appointment there was no hearing.
In this connection, be it recorded that Orissa High Court Legal Services Committee omitted to serve copy of the writ petition on the amicus curiae. As such and in any event, there is no difficulty for this Bench to proceed with hearing the writ petition. However, none appears on behalf of the workman.
The file contains the vakalatnama filed. The Registry is directed to serve website copy of this order on recorded learned advocate(s) of opposite party.
List on 27th April, 2023. Interim order to continue till next date of hearing.
