The writ petition is seeking for a Mandamus to direct the respondents to disburse the disability benefits to the petitioner as contemplated in the Money Back Policies and New Bhima Gold Policies of the Life Insurance Corporation of India.
2.The learned counsel appearing for the respondents had produced a communication sent by the Senior Divisional Manager, Madurai, to the petitioner dated 29.03.2014 holding that he is not eligible to the disability benefits as per the policy conditions.
3.In view of the fact that the petitioner's claim has been rejected by the respondents, the prayer as sought for in this writ petition could not be entertained. However, the petitioner is at liberty to challenge the said proceeding dated 29.03.2014 before the appropriate forum. When the petitioner approaches the appropriate forum, the period, namely the date of filing of this writ petition till the date of this order shall be excluded by the forum while calculating the period of limitation, if any.
4.With the aforesaid liberty, the Writ Petition is disposed of. However, there shall be no order as to costs.
