Judgment
Heard Mr. Vivek Rodrigues, learned Counsel for the petitioners and Mr. M. Salkar, learned Government Advocate, who appears for the respondents.
Mr. Salkar, on instructions, submits that the case of all the petitioners is covered by the decision of this Court in Writ Petition No.668/2014 dated 26.04.2017. He further states that in terms of the said decision, relief can now be granted to all the petitioners in terms of prayer clauses (a) & (b), which read as follows:
(a) Issue a writ of certiorari or a writ in the nature of certiorari, or any other appropriate writ, order or direction quashing and setting aside the impugned Circular dated 02.12.2010 issued by the respondent no.3 and the recoveries effected from the petitioners in pursuance thereof vis a vis these petitioners;
(b) To direct fixation of the salary and pensionary benefits of the petitioners in the pay scale of Rs.9300-34000+Rs.4800 (G.P.) along with future benefits based on the revised pay scales.
Mr. Salkar states that now there will be no question of recoveries from the petitioner based on circular dated 02.12.2010, which now stands set aside.
We now direct that the benefits should be granted to all the petitioners within six months from today. The petition is accordingly disposed of without any order for costs.
