Judgment
When the matter is taken up, nobody appeared on behalf of the Appellant.
From the perusal of the order dated 23.11.2022 it appears that on that date Ms. Tanvi Sharma, Proxy Counsel for Mr. Aatreya Singh, Advocate for the Appellant was present and submitted that Mr. Aatreya Singh, Advocate recently engaged in the matter, therefore, the matter was directed to be listed on 01.02.2023. On that date, nobody appeared on behalf of the Appellant and Counsel for the Respondent was appeared and the matter was directed to be listed on 11.04.2023. On that date also, nobody appeared on behalf of the Appellant and Counsel for Respondent was appeared and the matter was directed to be listed today i.e. 24.05.2023.
Today, when the matter is taken up, nobody appeared on behalf of the Appellant. Counsel for the Respondent is present.
In view of the fact that the Appellant has lost his interest as the Appellant has not been appearing for last three dates. In this circumstance, the instant Appeal is dismissed for non-prosecution.
