Judgment
THIS is an appeal against the order dated 31.7.1998 passed by District Forum, Allahabad in Complaint Case No. 1286/96.
LEARNED Counsel for the opposite party, Mr. Essar Hussain is present and Mr. M.H. Khan, learned Counsel for the appellant is also present. They have been heard. The only dispute in the present case is that the complaint has been dismissed on the ground that the complainant Savitri Khanna who is the appellant has no right to file the complaint as she is not a consumer. The electric connection was in the name of the firm. From the papers of registration and Income-tax department filed by the appellant, it is a clear that the appellant Savitri Khanna as well as Pankaj Khanna are partners of this firm. Hence, a partner is competent to file the complaint on behalf of the firm. Any partner is competent to file the complaint on behalf of the firm.
The appeal is, therefore, allowed and case is remanded to the learned District Forum, concerned for rehearing according to rules. Parties shall appear before the District Forum, concerned on 18.3.1999. Let copies be made available to the parties as per rules. Appeal allowed.
