Savita Kumari and Jyoti Thakur vs State of Himachal Pradesh and Others

Justice Kurian Joseph, C.J.—This writ petition is filed with the following prayer:

That this Hon''ble Court may kindly be pleased to issue the writ of Mandamus whereby the respondents may kindly be directed to consider the case of the petitioner for grant of revised pay scale as per letter dated 10.6.2005 given to the others similar situated persons which is flow from the Annexure P-1 Judgment passed in CWP (T) 14232 of 2008 dated 17-11-2008 titled as Nek Ram and others w.e.f. from their appointment till they are entitled.

The petitioners submit that they are similarly situated as the petitioners in the decision rendered by this Court in CWP (T) No. 14232 of 2008, titled Nek Ram and others versus State of Himachal Pradesh and others, decided on 17.11.2009. It is further submitted that the decision has also been implemented. In case the petitioners are similarly situated as the petitioners in the judgment, referred to above, similar treatment shall be given to the petitioners herein also, after verifying the facts, within a period of four months from the date of production of a copy of this judgment alongwith a copy of the writ petition and a copy of the judgment, referred to above, by the petitioners before the second respondent/competent authority.

The writ petition is disposed of, so also the pending application(s), if any.
