Judgment
Alok Singh, J.—This is an application seeking bail in FIR No. 189 dated 11.5.2010, under Sections 307/353/420/34 of Indian Penal Code and Section 25/54/59 of the Arms Act, registered at Police Station Sadar, District Rohtak.
As per the prosecution story, police had received secret information that some of the accused were coming towards Village Bahu Akbarpur in a XYLO car bearing Registration No. HR-22-0567. The police party signaled them to stop, however, instead of stopping accused have started firing at the police party. Record does not reveal that any of the police personnel has received any injury in the said firing by the accused. Accused-Petitioner is in judicial custody w.e.f. 12.5.2010. As per learned Counsel for the Petitioner, accused has no criminal history except one connected FIR for theft of XYLO Car.
Ms. Preeti Chaudhary, Assistant Advocate General, Haryana has reported that prosecution evidence has not been completed fully.
Considering totality of the facts and circumstances of the case and the fact that the case is not likely to be heard in near future, the present petition is directed to be allowed. Let Petitioner be released on bail to the satisfaction of the Trial Court.
