Judgment
The present petition has been filed by A1 in CC No.484 of 2019 on the file of Additional Mahila Court (Judicial Magistrate Level), Dindigul, seeking a direction to the concerned Court to recall the NBW issued on 20.08.2026.
According to the learned counsel appearing for the petitioner, he is working in CISF and at present, he was posted at Jharkhand. In such circumstances, he could not appear before the concerned Court. Hence, NBW has been issued. He further submitted that he would surrender before the concerned Court and co-operate for the trial.
In such view of the matter, this Court is inclined to pass the following orders:
■ There shall be a direction to the petitioner to surrender before the concerned Court on or before 21.09.2026;
■ On such surrender, the Court is directed to recall the warrant on the same day;
■ In case, the petitioner is irregular in his appearance, the learned Judicial Magistrate, Additional Mahila Court (Judicial Magistrate Level), Dindigul is at liberty to address a communication to the Superior Officer of the petitioner herein with regard to his non-appearance.
With the aforesaid observations, this Criminal Original Petition stands disposed of.
