Judgment
The present intra-court appeal is directed against the order of learned Single Judge dated 17.06.2026, whereby the writ petition filed by the appellant challenging certain instructions issued by Senior Divisional Manager, Life Insurance Corporation of India, Haldwani regarding engagement of BIMA SAKHIS was dismissed with liberty to the appellant to approach the Grievance Redressal Cell.
Learned counsel for appellant submits that the appellant, who is Development Officer, cannot avail the remedy before the Grievance Redressal Cell inasmuch as, the said remedy is available only to customers and agents, in cases of dispute with the department.
Learned counsel for LIC submits that under the Life Insurance Corporation of India (Staff) Rules 1960, under Rule 47, the appellant has remedy of filing appeal against the order of the Senior Divisional Manager.
Clause (b) of Rule 47(1) of the Life Insurance Corporation of India (Staff) Rules 1960 reads as under :
“(b)interprets to his disadvantage the provisions of any such orders, rules, rules or agreements, to the Board if the order is passed by the authority which made the orders or rules or rules or agreements, as the case may be, or by any authority to which such authority is subordinate, and to the authority which made such orders or rules or rules or agreements if the order is passed by any other authority.”
Learned counsel for the appellant could not dispute that the appellant has remedy of filing appeal under the aforesaid provision. He, accordingly, prays for liberty to avail the said remedy and further prays that order of learned Single Judge may be modified to that extent, to which learned counsel for LIC has no objection.
Accordingly, the appeal is disposed of with liberty to the appellant to avail the remedy of appeal provided under the Statutory Rules. The order of learned Single Judge dated 17.06.2026 shall stand modified to the aforesaid extent. All pleas and contentions are left open for being raised before the Appellate Authority.
Pending application(s), if any, also stand disposed of.
