This is an application for grant of bail.
While arguing the bail application, learned counsel for the petitioner contended that there is no dispute that the appellant was a child in conflict with
law at the time of alleged commission of offence and as per the provision under section 12 of the Juvenile Justice (Care and Protection of Children)
Act, 2015, the privilege is to be given to the petitioner in the matter of grant of bail unless there are materials before the Court that the release of the
petitioner is likely to bring him into the association of any known criminal or expose him to moral, physical or psychological danger or his release would
defeat the ends of justice, the bail application should be rejected.
In support of such submission, he relied upon the decisions of this Court in the cases of Ranjit Paika -Vrs.- State of Orissa reported in (2018) 71
Orissa Criminal Reports 45 and Chittaranjan @ Biswajit Sahoo -Vrs.- State of Orissa reported in 2018 (II) Orissa Law Reviews 377.
Learned counsel for the State submits that the matter may be taken up next week in order to enable him to go through the ratio laid down in the
aforesaid two decisions and also find out whether there is any recent decisions either of this Court, other High Courts or of the Hon’ble Supreme
Court on that point.
