Heard.

2.

Rule. Rule made returnable forthwith. Heard finally with the consent of the parties.

3.

The present petition challenges order of the Labour Court as also the Industrial Court. The Labour Court rejected the application filed by the petitioner under Section 30(2) of the MRTU & PULP Act for interim relief on 25.03.2022. On 23.01.2023, the Industrial Court dismissed the Revision (ULP) No. 10 of 2022 filed by the petitioner challenging the said interim order. It can also be seen from the narration in the petition that immediately after the dismissal of the revision by the Industrial Court, the petitioner filed an application below Exhibit U-2 to keep the said order in abeyance and approached this Court. On 03.02.2023, this Court granted interim protection, since it was granted by the Industrial Court Amravati.

4.

In that view of the matter, the interest of justice would be served by directing the Labour Court, Amravati to decide the Complaint ULP No. 11 of 2020 pending before the said Court within three months from the date of this order.

5.

With these direction and keeping all the contentions of the respective parties open and without making any comments on the merits of the matter, the petition is disposed of.

6.

Needless to mention that the interim protection would be continued till the decision of the Labour Court, since it is continued by this Court even though an application for interim relief was rejected.
