Mr. Pati, learned advocate appears on behalf of applicant and submits, the application is for modification of order dated 6th April, 2022, disposing of his client’s representation. In said order there was an observation made that his client may request opposite party no.1 for some time but it is entirely up to said opposite party to grant or not grant time. Applicant/petitioner was required to approach opposite party no.1 within two weeks from date.
He submits, his client approached within the time directed. The interim application discloses communication dated 21st April, 2022 made by the Municipality in allowing applicant up to 28th April, 2022 to comply with the requirements of order of allotment dated 30th December, 2021. He seeks direction upon the Municipality to allow his client to comply by 4th May, 2022 since in said notice dated 21st April, 2022, the Municipality has itself said that his client’s allotment order is subject to final order to be passed in WP(C) no.202 of 2022, due to be listed on 4th May, 2022.
There was no direction made by said order dated 6th April, 2022 for there to be modification as prayed for. Applicant is at liberty to produce this order before the Municipality and pray for extension of time to comply.
The I.A. is disposed of.
