Judgment

This is an application U/S.483 of BNSS by the petitioner for grant of bail in connection with Sonepur PS Case No.62 of 2026 corresponding to GR Case No.58 of 2026 for commission of offences punishable under Sections 318(2)/ 318(3)/ 336(3)/ 338/ 341(1)/ 340(2)/ 74/3(5) of BNS pending in the file of learned SDJM, Sonepur, on the main allegation of cheating the innocent and gullible public by taking money from them to appoint as Security Guard/Data Entry Operator in different organization by forging documents and signatures.
Heard, Mr. Abhilash Mishra, learned counsel for the Petitioner and Mr. S.C. Pradhan, learned Addl. PP in the matter and perused the record together with the written instruction as produced from the IIC, Sonepur PS.
After having consideration of rival submissions upon perusal of the record, the allegation discloses a tragic case of cash for job and it is found from the written instruction as submitted by the IIC that there was transactions of more than Rs. 2.5 Crores in the accounts of the Petitioner, but none of the job-seekers have been provided with the job. Besides, the FIR has been lodged by a number of persons alleging therein that the Petitioner has received Rs. 1,00,000/- each to provide job as Security Guard and Rs. 1,80,000/- each to provide job as Data Entry Operator, but they have not been provided with any job. In the context of the present allegation, this Court feels it proper to the decision of the Apex Court in State of Bihar and another Vrs. Amit Kumar @ Bachcha Rai; (2017) 13 SCC 751, wherein it has been held in paragraph-8 as under:-
““8. Xxx xxx xxx When the seriousness of the offence is such, the mere fact that he was in jail for however long time should not be the concern of the courts. We are not able to appreciate such a casual approach while granting bail in a case which has the effect of undermining the trust of people in the integrity of the education system in the State of Bihar.”
In view of the aforesaid facts and circumstance and on consideration of the materials placed on record and taking into account the allegation against the petitioner for deceiving hundreds of innocent and gullible public by taking Crores of Rupees on the pretext of providing job to them, this Court is not inclined to grant bail to the petitioner.
Hence, the bail application of the petitioner stands rejected. Accordingly, the bail application stands disposed of. A soft copy of this order be immediately transmitted to the concerned Court.
