The present petition has been filed seeking a direction to the respondents to give the petitioners an opportunity to appear for an interview which is to be held tomorrow i.e., 26/08/2023.

It is submitted by the counsel for the petitioners that the candidature of the petitioners have been rejected on the wrong premises that they do not possess the requisite qualification as per the UGC norms. It is stated that as per the UGC norms, the petitioners have submitted all the requisite documents which were required from them.

As per the instructions of the University, counsel for the State submitted that on scrutiny, the committee has raised the objection regarding non-submission of the requisite documents by the present petitioners and despite giving opportunity, the documents were not submitted, hence, their candidature were rejected.

As per the counsel for the petitioners, petitioner nos.2 and 3 were registered prior to July, 2009 for their Ph.D. programme and as required they submitted their Ph.D. degree and the certificate in this regard before the authorities. As far as the petitioner No.1 is concerned, he was enrolled for Ph.D. in the year 2014, hence the requirement of submitting the documents mentioned in sub-Section (a) of Clause 4.1 is not binding on him.

Considering the aforesaid, as an interim measure, it is directed that the respondents will permit the petitioners for appearing in the interview tomorrow, i.e., 26/08/2023. However, their result should not be declared and kept in a seal cover which would be subject to the final decision of this writ petition.

It is made clear that these petitioners will also not claim any equity on the basis of the order passed today.

Let the copy of this order be also supplied to the counsel for the State for necessary information and compliance.
