Satya Prakash vs State of U.P. and Another

Rajeshwar Singh, J.—The Pradhan of the village moved an application u/s 133 Code of Criminal Procedure complaining that the opposite parties had obstructed the public way. The opposite parties filed an objection. The SDM summoned one allotment register and ultimately found that the land was allotted to the opposite party and it did not create any obstruction in the Public way. So he dropped the proceedings u/s 133 Code of Criminal Procedure. The applicant went in revision to the Sessions Court and revision was dismissed. Then Pradhan has filed this application u/s 482 Code of Criminal Procedure. The grievance of the Pradhan that has been pressed before this Court is that the order was passed on his back. It does not appear from his affidavit that he did not have any information of the date. Moreover, from seeing the proceedings there does not appear to have been any abuse of the process of the Court or likelihood of any irreparable loss to the applicant. So it is not considered proper to interfere in this case u/s 482 Code of Criminal Procedure. The application is dismissed.
