Judgment
Rakesh Tiwari, J.—Heard learned Counsel for the parties.
It is alleged that the petitioner was employed with respondent No. 2 as a clerk and was given joining on 2.1.1987. He unfortunately all of sudden became a mentally disturbed person due to some family problems and he left his house in a state of unsound mind. It is stated that after about five years a neighbour of the petitioner had gone to Balaji for pilgrimage saw the petitioner there and informed about him to the wife of the petitioner incident. Thereafter the wife of the petitioner were gone to Balaji and had found the petitioner in a state of unsound mind. She then brought the petitioner to Shahadara Hospital and admitted him there for treatment.
After medical treatment, it is claimed that the petitioner became fully fit and thereafter getting medical certificate of discharge from District Hospital, Ghaziabad he moved an application to the respondent No. 2 on 8.5.2006 annexing therewith prayed for allowing him to join his duties.
It appears that petitioner was not permitted to join hence he filed writ petition before this Court, which was numbered as writ petition No. 62897 of 2006 by which the Court directed the respondent No. 2 to take a final decision in the matter pursuant to the letter dated 1.5.2006 in accordance with law within a period of two months. Respondent No. 2 thereafter rejected the claim of the petitioner vide order dated 13.2.2007 after enquiry into the matter.

Aggrieved by the order, the petitioner has filed this writ petition.
It appears from the impugned order that the petitioner filed forged document as well as letters to form a basis for reinstatement. This Act of his raises a cloud on the authenticity of his explanation for running away from duty for five years. If a person can forge documents for supporting his case he can also concoct a story of being unsound mind missing for years. Such a person cannot be permitted to be reinstated in service in the facts and circumstances of this case. It is, therefore, not a case of interference under Article 226 of the Constitution of India.
The writ petition is accordingly dismissed.
