Judgment
M. Katju, J.—Heard learned counsels for the parties.
This writ petition has filed against the impugned order, dated 16111987 by which the service of the petitioner has been terminatedand the appellate order dated 2431990 dismissing his appeal.
The petitioner was a junior booking clerk in the service of the respondents. On 811986 he was travelling in a bus which was conducted by one Sri Jitendra Singh. This bus was checked by the Traffic Superintendent and the Traffic Inspector and the petitioner was found with torn tickets and waybill and when he was asked to show the waybill and tickets he refused to show them and began to run away.
An enquiry was held against the petitioner in which he was found guilty and thereafter his service was terminated. A perusal of the termination order, dated 16111987 shows that findings of fact have been recorded there in that the petitioner took the tickets and waybill from Jitendra Singh, Conductor and tried to run away by catching the bus going to Garh from Gajraula but he was caught by the police. He also admitted this fact that he used to deposit blank way bills. The petitioner has thus been found guilty of gross misconduct. I am not inclined to interfere with the impugned order. The petition is dismissed.
