On 9.3.2021, this Court passed the following order:

"Issue notice. Mr. Bhupinder Thakur, learned Deputy Advocate General, and Mr. Vikrant Thakur, Advocate, appear and waive service of notice on behalf of respondents No.1, 2 and 3, respectively. Learned Senior Counsel for the petitioners, on instructions, states that his clients are ready and willing to take pre­mature retirement as BDO, i.e., the current assignment with them. The proposal appears to be quite genuine.

Let respondents/State to obtain instructions in this regard. List on 23rd March, 2021."

Learned Additional Advocate General has placed on record instructions dated 20th March, 2021, which reveal that the petitioners are at liberty to take pre­mature retirement as BDO at their own volition, as is evident from the reading of Clause (d) of para 14, which reads as under:

"14.(d) Thus, the plea so taken by the petitioners to provide relaxation from the criteria of Graduation does not hold good and is not sustainable in the eyes of law and therefore, are at liberty to take pre­mature retirement as BDO at their own volition."

Accordingly, the instant petition is disposed of with a direction to the respondents to consider the cases of the petitioners for pre­mature retirement as BDO. Pending application(s), if any, also stands disposed of.
