By this petition the petitioner has challenged the order of the respondent No.2 seeking to demolish his construction. One of the ground for preferring this petition was that there was no Chairman of the Tribunal under the Punjab Road Schedule and Control Area Restriction of Unregulated Development Act, 1963.
Notice of motion.
On the asking of Court Mr. Aman Bahri, Addl. A.G., Haryana accepts notice on behalf of the respondents and has informed the Court that by notification dated 22.09.2020 the charge of the functions of the Tribunal has been handed over to Justice Darshan Singh (Retired) for a period of one year till further appointment, which ever is earlier, with immediate effect.
In the circumstances, we dispose of this petition with liberty to the petitioner to file an appeal alongwith the application for stay before the Tribunal. In case the appeal is filed alongwith the application for stay within 10 days from the date of receipt of a certified copy of this order there shall be an interim stay on any demolition till such time as the said application for stay is considered by the Tribunal.
Petition stands disposed of with the above terms.
Since the main case has been decided, the pending C.M.
Application, if any, also stands disposed of.
