Judgment

Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.RC6(S)/2017/CBI/SCB/CHG dated 14.02.2017 registered under Sections 148, 149, 188, 395, 397, 427, 436, 506 (earlier registered as FIR No.102 dated 26.02.2016 under Sections 148, 149, 188, 395, 427, 436, 506 IPC at Police Station Urban Estate, Rohtak) at Police Station CBI, SCB, Chandigarh.
Vide order dated 16.03.2021, the arrest of the petitioner was stayed by this Court.
Counsel for the petitioner has submitted that the matter has been amicably settled between the parties out of the Court and some of the prosecution witnesses have not supported the prosecution version and they were declared hostile.
Counsel for the respondent – CBI has not disputed the fact that some of the prosecution witnesses have not supported the prosecution case.
In view of the above, considering the fact that the some of the prosecution witnesses have not supported the prosecution case, the present petition is allowed and the order dated 16.03.2021, vide which the arrest of the petitioner was stayed, is made absolute.
Liberty is granted to the prosecution to revive this petition, if at any stage, it is found that there is no valid compromise between the parties.
