Judgment

The challenge in the proposed Criminal Revision is to an order dated 20.09.2023, passed by learned Sub-Divisional Magistrate, Ramnagar, District Nainital in Case No. 11/01 of 2023 under Section 133(1) of the Code of Criminal Procedure, 1973.
Heard Mr. Bhupesh Kandpal, learned counsel for the revisionist and Mrs. Manisha Rana Singh, learned A.G.A. for the State.
Mr. Bhupesh Kandpal, Advocate, submits that the property-in-dispute, situated in Khata No. 24, Khasra No. 101/5 admeasuring 0.4100 hectare, was purchased by the revisionist vide sale-deed dated 09.08.2019 and his name has already been mutated in the revenue record.
Mr. Bhupesh Kandpal, Advocate, requests to decide the present Revision directing the concerned Sub-Divisional Magistrate to consider the said documents, filed by the revisionist.
The said request has not been opposed by the State.
With the consent of both the parties, the proposed Criminal Revision is disposed of directing the concerned Sub-Divisional Magistrate to decide the Case No. 11/01 of 2023 most expeditiously and in accordance with law after considering the documents available on record and after granting opportunity of hearing to the revisionist Satnam Singh.
Let a certified copy of this order be supplied to learned counsel for the revisionist, today itself, on payment of usual charges.
