Thiis is the third petition filed under Section 483 of Bharatiya Nagarik Surakshha Sanhita (BNSS) for grant of regular bail to the petitioner in case bearing FIR No.0009 dated 03.03.2022 under Sections 22(c) of NDPS Act (Sections 61 and 85 of NDPS Act added later on) registered at Police Station Harike, District Tarn Taran (Annexure P-1).
Leaarned State counsel, at the very outset, submits that this is the third attempt made by the petitioner for grant of concession of regular bail. The second petition was withdrawn on 12.08.2024. He further submits that out of 12 witnessess cited by the prosecution, 03 have been examined and the petitioner has beeen found in conscious possessioon of contraband, falling within the ambit of commmercial quantity.
In view of the above, learned counsel for the petitioner wishes to withdraw the present petition.
However, keeping in view the fact that the petitioner is behind the bars since 03.03.2022, Senior Superintendent of Police, Tarn Taran is directed to take appropriate steps to ensure the presence of prosecution witnesses, before the learned trial Court and the learned trial Court is directed to conclude the trial expeditiously, preferably within a period of 06 months.
