Learned Counsel for both side are present.
Firstly, Miscellaneous Applications moved, in these Broadcasting Petitions, are to be disposed of. The prayer is with regard to rate of interest to be awarded, in case of allowing these petitions, as to whether, interest is to be paid in general proposition or in accordance with Section 16, of the Micro, Small and Medium Enterprises Development Act, 2006 (MSMED Act). The relief prayed in original petition is with no prayer for interest and the main objection over these MAs, are with regard to the application of MSMED Act. In these Petitions, filed under TRAI Act, 1997. No where in the agreement, which is the basis of these disputes are in original petitions. There was mentioning of this MSMED Act, by Petitioner.
Hence, for hearing over the point, as to whether above Act is applicable for these disputes or not, the opportunity is to be given for bringing precedent, if any, and placing arguments over this point, before this Tribunal.
