Judgment

This case was registered under section 307/498, Indian Penal Code, for alleged attempt to murder Neelam married to Satish Kumar, applicant, on 23.1.1988. The occurrence took place on 5 8.1988 when the motherinlaw along with husband''s sister and brother Harish Kumar tried to murder Neelam by strangulating her with a Chunni. She was rescued by her brother Subhash reaching there just in time in order to deliver her chappals, which she had forgotten at her parental house.
The motherinlaw and sister of the husband have already been granted bail. An application for anticipatory bail on behalf of Harish Kumar brother of the husband is pending consideration.
Neelam was medically examined. No injury was found on her mouth or area of the neck.
After hearing learned counsel for the parties and without intending to express any opinion on the merits of the case, Satish Kumar, applicant, is allowed bail in the sum of Rs. 5000/, with one surety in the like amount to the satisfaction of Chief Judicial Magistrate, Hissar.
