Judgment
Alok Singh, J.—Record reveals that petitioner got registered a sale deed for the land measuring 2 kanal 16 marlas (1700 sq. yards) for a consideration of Rs. 5,50,000/-. Learned Collector has observed in the impugned order that petitioner got the sale deed registered by showing the constructed factory as a vacant land and had there been any mention that building is constructed thereupon, stamp duty must have been charged then and there on the building, as applicable at the particular time. On being asked as to whether the finding of fact recorded by the learned Collector that over the land in dispute a constructed factory is there, is correct or not, learned counsel for the petitioner states that a godown in dilapidated condition is there on the land in question but it was not being used.
From the statement of learned counsel for the petitioner it stands proved that petitioner got the sale-deed registered by showing the constructed portion as vacant land and concealed the material facts. Therefore, there is no need to interfere in the impugned order and the petition is liable to be dismissed with exemplary costs.
Accordingly the petition is dismissed with costs of Rs. 10,000/-to be paid by the petitioner to the Legal Aid Committee of this Court within 15 days.
