Judgment
Ms. Gita Dhingra, Advocate has put in appearance on behalf of the respondents. Arguments heard.
The petitioners seek transfer of rent appeal bearing RCT No.21/2016 (earlier No.ARCT No.23/2015) titled as 'Mukesh Chopra & Anr. Vs. Manohar Singh Kapoor (Through LR's)' from the court of learned RCT (since retired) West District, Tis Hazari Courts, Delhi to any other learned RCT in Delhi.
The learned counsel for the petitioner contends that after demitting the office on attaining the age of superannuation on 31.10.2017 by Ms. Rekha Rani the learned RCT, no new incumbent has been appointed and the rent appeal of the respondents No.1 and 2 against the order of their eviction has been pending. He contends that the petitioner No.1 being 74 years of age, is a senior citizen.
For the expediency of justice, the appeal bearing No.RCT No.21/2016 (earlier No.ARCT No.23/2015) titled as 'Mukesh Chopra & Anr. Vs. Manohar Singh Kapoor (Through LR's)' is transferred from the court of learned RCT, West District, Tis Hazari Courts, Delhi to the learned RCT, Central District, Tis Hazari Courts, Delhi for disposal in accordance with law.
The parties are directed to appear before the learned RCT, Central District, Tis Hazari Courts, Delhi on 17.01.2019.
The petition is disposed of accordingly.
