Judgment
Vivek Singh Thakur, J
Petitioner has approached this Court seeking bail under Section 438 Code of Criminal Procedure (in short ‘Cr.P.C.’), in case FIR No. (not known to the petitioner), dated (not known), registered in Police Station Solan, District Solan, H.P., under Section 420 of the Indian Penal Code (in short ‘IPC’).
Status report stands filed, wherein it has been informed that there is no case registered in Police Station Solan, H.P., against the petitioner. However, a joint application was received against him from Attar Singh, Naresh Kumar and Jagmohan Pundir, residents of District Sirmour, H.P., levelling certain allegations against the petitioner and for verification thereof, petitioner was asked to come to the Police Station for inquiry in that regard, but he instead of attending the inquiry in the Police Station has approached this Court by filing present petition. Whereas, in this regard no FIR has been registered as on date against him.
In view of above report, nothing survives to be adjudicated in the present petition and the same has become infructuous and disposed of accordingly.
SHO/Incharge Police Station concerned is directed that in case FIR is registered against the petitioner and his custody is warranted in such FIR, then he shall be given at least two days’ prior notice.
