Petitioner is the first accused in Crime No.2157/2019 of Kundara Police Station, which was registered alleging offence under Section 397 of the
I.P.C and also Section 27(2) of the Arms Act. He has moved this application under Section 439 of the Cr.P.C. seeking regular bail.
I Heard counsel on both sides.
The petitioner was arrested on 04.10.2019 from Delhi and formally arrested for the case on 26.10.2019. According to the learned counsel, for about
two years he is in custody.
But after hearing learned Public Prosecutor, I am convinced that the petitioner cannot be released on bail. He is an inter-State criminal involved in
large number of cases pending across different States. Here, the allegations are under Sections 120B, 395 and 397 of the IPC. He was arrested with
great difficulty from Delhi for the case. It was submitted by the learned Public Prosecutor that hundreds of cases are pending against all over India. It
is not in public interest to release such a hardcore criminal.
The bail application is dismissed.
