This matter is taken up through hybrid mode.

Heard Mr. A.P.Bose, learned counsel for the petitioner and Mr. P.C.Das, learned Addl. Standing Counsel for the State. This Criminal Revision has been filed by the petitioner challenging the order dated 28.9.2021 passed in Misc. Case No.517 of 2021 by the learned Executive Magistrate, Khurda wherein the learned Executive Magistrate has restrained the petitioner and opp. party Nos.3 and 4 and one Shyama Prasanna Mitra from entering into the case land, i.e., Plot No.475 until further order.

Perusal of the impugned order reveals that notice had been issued to the opp. parties to appear in Court on 8.10.2021 and submit show cause and direction was also issued to the Tahasildar, Khurda to enquire into the matter and submit report.

Show cause filed by the Opp. parties on 8.10.2021 has been annexed to this petition as Annexure 5 .

Learned counsel for the petitioner states that after their appearance, the case was adjourned to 8.11.2021 and thereafter on the prayer of the petitioner it has been adjourned to 12.11.2021.

I feel that since the opp. parties have filed their show cause before the learned magistrate and the period of 60 days will soon be completed , no fruitful purpose will be served by entertaining this application .

The learned Executive Magistrate, Khurda shall do well to dispose of the Misc. Case No.517 of 2021 pending before him expeditiously , but strictly in accordance with law. The CRLREV is accordingly disposed disposed of . Urgent certified copy of this order be granted as per rules.
