The present bail applications have been filed under Section 439 Cr.P.C. by the single petitioner - Sarvesh Kumar @ Vinod Kumar S/o Bankelal, who has been arrested in connection with F.I.R No.435/2022 (in CRLMB No.1871/2023) & F.I.R. No.530/2022 (in CRLMB No.2219/2023), registered at Police Station Pratapnagar, District Bhilwara, for the offences under Sections 406, 420, 467, 468, 471 & 120-B IPC.

Learned counsel for the petitioner submits that the offences alleged to have been committed by the petitioner are triable by Magistrate. Challan of the case has already been filed. The accused-petitioner is in judicial custody and the trial of the case will take sufficiently long time to be concluded. Therefore, the benefit of bail should be granted to the accused-petitioner.

Learned Public Prosecutor has opposed the bail application. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, the bail applications filed under Sec.439 Cr.P.C. are allowed and it is directed that petitioner Sarvesh Kumar @ Vinod Kumar S/o Bankelal shall be released on bail in connection with F.I.R No.435/2022 (in CRLMB No.1871/2023) & F.I.R. No.530/2022 (in CRLMB No.2219/2023), registered at Police Station Pratapnagar, District Bhilwara provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each (in each F.I.R.), to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
