In the present writ petition, the petitioner is claiming benefit of arrears in respect of revision of pay scale as effected by the Government of Haryana vide 6th Pay Commission, which are yet to be paid to the petitioner.

The petitioner, who was working as Craft Teacher with the Panchayat Samiti, Kaithal retired on attaining the age of superannuation on 28.02.2011. By the time the petitioner retired, the benefits of the revision of the pay, which was effected in pursuance to recommendations of the 6th Pay Commission w.e.f. 1.1.2006, was not granted to the petitioner and on account of said revision of pay, the petitioner became entitled for arrears amounting to Rs. 4,36,000/- which are being claimed in the writ petition as those are yet to be released to the petitioner.

Learned counsel for the petitioner argues that though, eight years have been elapsed, but, out of Rs. 4,36,000/-, a sum of Rs. 1,02706/- yet to be released by the Panchayat Samiti and same has been withheld only on the ground of financial difficulty. Prayer of the petitioner is that a direction needs to be issued to the respondents to release the said amount forthwith.

Learned counsel for the respondents states that no one from the department has come present to assist her. She undertakes that in case the arrears are still pending to be paid to the petitioner on account of revision of pay, an appropriate order shall be passed in respect of the claim of the petitioner for the release of arrears on account of revision of pay scales within a period of two months from the date of receipt of certified copy of this order and in case it is found that any monetary benefit is yet to be released, the same will also be released to the petitioner within a period of one month thereafter.

Learned counsel for the petitioner states that in view of the statement made by the learned counsel for the respondents, he does not wish to press the present writ petition any further and the same may be disposed off as having been not pressed.
