Heard learned counsel for the petitioner and the learned Additional Advocate General for the respondent.
I have gone through the status report submitted by the Police. The petitioner herein is accused for providing assistance in transportation in the taxi which he owns. It is urged before me that the main accused Surjit Singh has since died and that a First Information Report with respect to that incident has been filed against the complainant in this case. The role ascribed to the petitioner is only that he was plying his maruti van as a taxi and had offered his services for hire and reward thus helping the accused. He is in judicial custody.
Looking to the totality of the facts and circumstances of the case, this petition is allowed. The petitioner is directed to be released on bail subject to his furnishing personal bond in the sum of Rs. 50,000/- with one surety in the like amount to the satisfaction of learned Judicial Magistrate 1st Class, Nurpur. The petitioner shall undertake that he will not interfere with the prosecution evidence, tamper with, try to overawe, influence or threaten prosecution witnesses nor in any manner try to obstruct the progress of the trial. He shall make himself available for the investigation if so required by the prosecution. He shall not abscond from the jurisdiction of the learned Sessions Judge, Kangra at Dharamshala. He shall attend the trial on each and every date unless exempted from appearance. This application stands disposed of.
