Hon’ble Pankaj Purohit, J. (Oral)

Petitioner has impugned a First Information Report No.0154 of 2026 dated 23.09.2026 registered with Police Station Dineshpur, District Udham Singh Nagar, under Sections 5/6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012, and under Sections 351(3), 64 of the BNS, 2023.

2.

It is contended by learned counsel for petitioner that there is one month’s delay in lodging the first information report and in the first information report, name of hotel and in whose identity the hotel’s room was rented, was not mentioned and there are discrepancies in the age mentioned in the FIR with the actual age of petitioner.

3.

From perusal of the FIR, it transpires that prosecutrix was 17 years of age and she was allegedly being induced by petitioner for the last six months and on that inducement, she was subjected to sexual harassment; the prosecutrix was also threatened that petitioner was having a video of prosecutrix and the same would be made viral if she refused to get sexual intercourse with petitioner.

4.

Having perused the first information report and more particularly keeping in view the age of victim, this Court is of the view that this is not a case where interference is warranted. The offences alleged against the petitioner are very serious in nature.

5.

Accordingly, the criminal writ petition is dismissed in-limine.

6.

Pending application, if any, stands disposed of accordingly.
