Mr. B.Deb, learned counsel for the petitioner submits that by order dated 21-03-2022 passed in WP(C). No. 278 of 2020, withdrawal had been sought from this Court to allow the petitioner to seek alternative relief under the Indian Succession Act. 1925. However, he submits that on obtaining a copy of the application filed before the lower court, it appears that the said proceedings before the lower court was not under the Indian Succession Act, 1925 by was a simple application for adjudication on which certain orders had been passed.

Mr. H.Abraham, learned GA for respondents No. 1-4 submits that the review application should not be entertained, inasmuch as, the order passed by the lower court was in the knowledge of the petitioner before they had approached this Court by way of WP(C). No. 278 of 2020.

Be that as it may, in the interest of justice to enable the petitioner to seek alternative relief, this review application is allowed and the order dated 21-03-2022 is recalled.

Accordingly, review petition stands disposed of. Registry to list WP(C). No. 278 of 2020 for orders after one week.
