Learned counsel for the petitioners submits that the three applications filed by the petitioners/plaintiffs under Order 13 rule 10 of the CPC, under

Order 1 rule 10 read with Order 6 rule 17 of the CPC and under Order 7 rule 14 of the CPC are pending consideration before learned Additional

District Judge, Dhamtari and without deciding these applications, the case has been fixed for plaintiffs' evidence which is wholly improper.

I have heard learned counsel for the petitioner at length.

Be that as it may, learned trial Court is directed to decide all the aforementioned applications within 7 days from the date of receipt of a copy of this

order and thereafter, matter be proceeded further. It is expected learned Additional District Judge, Dhamtari to decide the pending applications side by

side particularly, when the case has been fixed for plaintiffs' evidence.

The writ petition stands disposed of accordingly. No order as to cost(s).
