As per Ext P1 proceedings, the petitioner was granted a regular permit subject to settlement of timings. The petitioner claim that he had sought for issuance of regular permit on the vacancy of a defaulted stage carriage bearing No.KL-23/E 3831. This Court as per judgment dated 07.03.2022 in W.P(C) No.7288 of 2022 clarified that the claim of the petitioner seeking allotment of the timings of the alleged defaulted service can also be taken to consideration while settling the timings. It was further directed that all effected/interested parties shall be put on notice regarding the settlement of timings.
Though the timing conference was scheduled on 29.03.2022, the same was adjourned to 02.04.2022 and thereafter it has been adjourned without fixing a date. The additional respondents 3 and 4 have objected to the timings as sought for by the petitioner. The petitioner seeks for settlement of timings and issuance of regular permit without any further delay.
Heard the learned counsel on either sides.
Without expressing anything on the merits the Writ Petition is disposed of directing the authority to have the timings of the petitioner settled, with due notice to all affected/interested parties and also taking into consideration the objections of the additional respondents 3 and 4. The authority shall also take into consideration the timings as sought for by the petitioner. Let the needful be done within a period of one month from the date of receipt of a copy of this judgment.
