On 19.07.2023, in Criminal Misc. Application (For Condonation of Delay) No.1 of 2023 in Criminal Appeal No.18187 of 2023, this Court has passed following order:
“Learned advocate Mr. Arshad Shaikh for Mr. Abrar G. Saiyed for the applicant seeks permission to withdraw the present application with a view to file a fresh application before concerned trial Court.
Permission as prayed for is granted. This application stands disposed of as withdrawn.”
Considering the fact that the aforesaid order was passed in application for condonation of delay which should have been passed in Criminal Appeal, the office has placed a note dated 07.08.2023. In view of above, following order is passed:
As it is recorded in the order dated 19.07.2023 that learned advocate Mr. Shaikh had withdrawn the application with a view to file a fresh application before the concerned trial Court, the present Criminal Appeal stands disposed of as withdrawn with a view to enable the present applicant to prefer fresh application before the concerned trial Court.
In view of that, present appeal stands disposed of as withdrawn.
