Sardul Singh vs State of Punjab and others

Prayer in this petition filed under Section 482 Cr.P.C. is for

issuance of a direction to the respondents to file final report under Section 173

Cr.P.C. in FIR No.22 dated 13.03.2017 under Section 304 read with Section

34 IPC registered at Police Station Ramdas, District Amritsar (Annexure P-1).

Record reveals that earlier also, the petitioner had approached

this Court for the same relief by way of CRM-M No.14412 of 2017 titled as

Sardul Singh Versus State of Punjab and others and while disposing of the

said petition on April 27, 2017, this Court had passed the following order:

"Heard. Learned counsel for the petitioners submits that FIR No. 22 dated 13.03.2017 was registered for offence punishable under Section 304 read with Section 34 of Indian Penal Code against respondent No. 4 for the death of son (Shamsher Singh) of petitioner. Representation (Annexure P-2) to this effect was given to the police by the petitioner, but no action has been taken. Without expressing any opinion on merits, this petition is disposed of with direction to respondent No.2-Senior Superintendent of Police, Amritsar (Rural) to look into the representation made by petitioner Annexure P-2 and take appropriate action in accordance with law."

Since the prayer made by the petitioner in the present petition

has already been considered in the earlier petition filed by him, this Court

finds that no interference is warranted.

The present petition is, accordingly, dismissed.
