Heard learned Counsel for the petitioner and perused the record.

By means of this writ petition, the petitioner has sought a writ in the nature of mandamus commanding the respondent No. 1 to decide the Misc. Case No. 100 of 2009 Sardar Sukhdev Singh v. Param Jeet Singh Sainti within a time bound period.

According to the petitioner, he submitted a complaint before the Deputy Registrar, Firms, Societies and Chits, Haldwani, who in turn remitted the matter to the Sub Divisional Magistrate Haldwani, who is the Prescribed Authority u/s 25 of the Societies Registration Act, 1960.

The grievance of the petitioner is that the proceeding is pending since 27-11-2009 for disposal and the matter relates to election of Khalsa National Girls Inter College Haldwani and Shri Guru Teg Bahadur Public School Haldwani (Nainital) dated 23-11-2009.

In the facts and circumstances of the case since the case is pending for disposal since 27-11-2009, the respondent No. 1-Prescribed Authority/SDM Haldwani is directed to decide the Misc. Case No. 100 of 2009 Sardar Sukhdev Singh v. Paramjeet Singh Santi, in accordance with law after hearing both the parties, expeditiously, preferably within a period of three months from the date of production of certified copy of this order.

With the above direction, the writ petition is disposed of finally.

All pending applications stand disposed of.
