Judgment
Arvind Kumar, J.—The present Petitioner is the Plaintiff in the suit for permanent injunction filed through attorney, Kartar Singh Gill, titled Sarban Singh v. Joginder Singh and Ors. The relief claimed was for restraining Defendant No. 1 Joginder Singh from interfering in the peaceful possession of the Plaintiff or shifting the tubewell connection. Joginder Singh admittedly has expired. The application of the Plaintiff for bringing on record the legal representatives of the deceased has been dismissed vide impugned order dated 31.3.2010. Hence, this revision.
Heard.
Joginder Singh was the sole contesting Defendant. The relief claimed was for restraining him from shifting the tube-well connection. The impleadment of his legal representatives is necessary. In this back-drop of the facts, the revision petition is allowed, impugned order is set aside and the application of the Plaintiff for bringing on record the legal representatives of deceased Joginder Singh is allowed. Let the needful be done before the trial Court.
