Judgment
The Learned Counsel for the Appellant would submit that the impugned order was passed on 18.03.2021 by DRT-II, Mumbai, but the present Appeal was filed on 11.08.2022.
Heard on the delay condonation application of I.A. No. 248/2023.
The Hon’ble Supreme Court in Suo Moto Writ Petition (Civil) No. 2/2020 excluded the period from 15.03.2020 to 20.02.2022 for computing limitation across all Courts and Tribunals due to Covid regulations. As the impugned order was passed on 18.03.2021, therefore, the appeal should have been filed on or before 17.04.2021. But as per the Hon’ble Supreme Court, after excluding the period, it should have been filed on or before 31.03.2022. However, the Appeal was filed on 11.08.2022. Accordingly, there is a delay of four months and eleven days in filing the present appeal.
The Learned Counsel for the Respondent would submit that the delay may be condoned, subject to payment of costs.
The delay is sufficiently explained.
Accordingly, the I.A. No. 248/2023 is allowed subject to payment of the cost of ₹5,000/- to the Prime Minister’s Relief Fund and the delay of 467 days in filing the Appeal stands condoned.
The Learned Counsel for the Appellant would submit that the principal amount involved is approximately ₹2,80,000/- and there is a possibility.
The Learned Counsel for the Appellant would submit that the Appellant shall approach the concerned Authorised Officer of the Bank on 22.04.2026 at 12:00 p.m for a meeting or negotiation.
List the matter on 24.07.2026 for reporting settlement/hearing.
