1.

It is an application for bail under Section 439 of the Cr.P.C. in Sessions Case Ors No.14/2021 pending before the Additional Sessions Judge, FTC-II, South Goa, Margao.

2.

The applicant/accused no.1 in the aforesaid Sessions Case is facing trial for the offence punishable under Section 370(3) read with 34 of IPC and Sections 4,5, and 7 of Immoral Trafficking (Prevention) Act, 1956.

3.

The prosecution has examined material witnesses, excepting the investigation officer, decoy customer, and one technical witness. Since the trial has progressed significantly, in my view, it would not be proper to entertain the bail application in midst of it. Thus it would expedient to request the learned Judge to make an endeavour to conclude the trial in Sessions Case Ors. No.14/2021 preferably within six weeks from today. If the trial does not conclude before that day, the applicant may renew his request for bail.

4.

Application is disposed of in the aforesaid terms.

5.

It is made clear that I have not heard the applicant on merits.

6.

It is clarified that the trial Court shall proceed with the matter on its own merits without being influenced by the observations made in the present order.
